CHAPTER(17) Why are two women equal to one man in testimony?
Question :- Why are two women equal to one man in testimony? IQRARKHAN
Answer: It is not true that the testimony of two women is always equal to that of one man. This is only in some cases. There are at least five such verses in the Qur'an that refer to the testimony of witnesses. But in them there is no talk of difference between women and men. Verse 282 of Sura Bakra of the Qur'an, which is the largest verse of the Qur'an, contains orders regarding goods and transactions. The translation of that verse is - "O believers! When you deal with each other for a certain period of time, write it down... and take two witnesses from among your men, if two If there are no men, then one man and two women whom you like as witnesses, so that if one is confused, the other may remind him." (Qur'an, 2:282) This verse deals with the trade and sale of goods. In such cases, it is being ordered that such an arrangement should be made in writing between both the parties and for this two witnesses should be produced. It is better that both of them are men. If two men cannot be found, then one man and two women will suffice. For example, if a man wants to undergo an operation for a particular disease, he gives priority to knowing about the right treatment. To know about the opinion of two qualified and recognized doctors. If he cannot find two surgeons, then one surgeon and two general doctors who are only MBBS, contacts him because the other now as an option
[9:08 am, 24/12/2021] Ikku: That's what remains about him. Similarly, in goods or business transactions, preference is given to two men. Islam sees the man as the one who is responsible for meeting the financial needs of his family members. Now since the financial responsibility rests with men, they are expected to have more ability, capability and experience in business matters than women. Alternatively, witnesses can be one man and two women. The reason for this is that if one woman makes a mistake, the other woman can correct that mistake. The Arabic word used in the Qur'an is 'Tazil' which means to make a mental confusion or mistake. Some people have mistranslated it which is wrong. Thus, a gardener or business transaction is the only case in which two witness women are equated with one witness man. Some Islamic scholars hold the opinion that the behavior of women is influenced by the testimony of a murder case. In such cases, women become more fearful and terrorized than men. Due to this emotionality, they can become a victim of a lot of mental confusion. Therefore, in the view of some theologians, the testimony of two women in the case of murder is equivalent to the testimony of one man. There are five such verses in the Holy Qur'an which throw light on the subject of testimony. But there is no mention of man and woman in any of them. Two justice-loving persons are required as witnesses in preparing the papers for the division of the inheritance. It is said in the Holy Qur'an- "O believers! When the time comes for one of you to die, then at the time of the will, two just among you should be the witnesses. Or two other people from among your non-believers should be the witnesses, it is at that time." that if you have gone on a journey and death may come upon you.” (Qur'an, 5:106)
[9:10 am, 24/12/2021] Ikku: "Four persons are needed for justice in the case of accusing a woman." The testimony of two women being equal to the testimony of one man is applicable in all cases. This view cannot be agreed upon in any way, because the Holy Qur'an's sura 24 Noor verse 8 very clearly states that of a man and a woman. justifies the testimony." Even a wife can avoid punishment by swearing four times to Allah that she is a liar. (Qur'an 24: 8). There is also a testimony in the Hadith of Hazrat Aisha (R.G.). Many theologians are of the same opinion that only a woman's testimony is sufficient to see the moon. Consider that A woman's testimony is enough for an important pillar of Islam i.e. fasting of all Muslim men and women on the testimony of a woman. Some theologians say that a woman's testimony will suffice for the fast of Ramadan while at the end of it ie Two witnesses will be required on the day of Eid. There will be no distinction between a man and a woman in this regard. In some cases only the testimony of a woman is required. The testimony of a man will not be accepted in that case, for example women. In cases, such as the witness at the time of giving ghusl to the dead body of a woman, it is not the gender inequality that is evidently seen in trade and material matters. It is really only that men and women have their own natural characteristics and different roles in society, which Islam has given to them. fixed for each
